How we prove a brain injury

Brain injuries are often invisible on a standard scan, which is exactly what the other side argues. This is the process we use to document one.

  1. Objective medical testing

We work with neurologists and brain injury specialists to choose tests that actually confirm the extent of the injury.

  2. Medical coding and diagnosis

Documented CPT codes tied to a diagnosed brain injury, so the claim rests on the record rather than on description.

  3. Full medical history review

Every reported concussive symptom is pulled into a clear timeline, including the ones noted in passing months ago.

  4. Witness interviews

Family, colleagues and friends give before-and-after testimony showing how daily function has changed.

  5. Telling your story

We present what living with an invisible injury is actually like, and how it will keep affecting your life.

You were told the scan was clear. You still don't feel right.

A brain injury does not always show up in an emergency room. If several of these have been true since the incident, it is worth a conversation.

Symptoms often arrive late. Many people feel reasonably normal for days or weeks, then find that concentration, sleep or temper have changed. That gap is one of the main reasons brain injuries go undiagnosed, and it is not a reason your claim is too late to look at.

Why a normal scan does not mean no injury

A standard CT or MRI is built to find bleeding, swelling and fractures. It is not built to find the microscopic damage that causes most concussion symptoms. That is why so many people are discharged the same day and told they are fine.

Diffuse axonal injury happens when the brain is thrown forward and back hard enough to tear connections at a cellular level. It rarely appears on a routine scan.

There are tests that can show what a standard scan misses. Diffusion tensor imaging maps the white matter connections themselves. Videonystagmography measures the eye movements that reveal balance and vestibular damage. Neuropsychological testing measures the memory and processing changes you are living with.

We work with neurologists, neuropsychologists and imaging specialists to document what the first scan did not.

Denver crashes, and why the claims go wrong

We know the roads these happen on. The morning crunch on I-25 at the Speer merge, the I-70 Mousetrap, the tight turns near Union Station, Colorado Boulevard at the end of the day. Snow, hail and glare make all of it worse.

A normal scan proves nothing

Mild traumatic brain injury frequently does not appear on standard CT or MRI. Insurers treat a clean scan as evidence there was no injury. It is not.

Symptoms arrive late

Memory trouble, light sensitivity, irritability and word-finding problems often surface weeks after the crash, once the claim is already being minimised.

We can come to you

We meet clients near Cherry Creek, City Park, RiNo, Washington Park and Sloan’s Lake. If getting across town is too much right now, phone or video works.

What has to be proved

  1. You have a brain injury

    Medical records, imaging and testing.

  2. The crash or fall caused it

The mechanism, the forces involved, and what changed afterwards.

  3. The injury is what is causing your difficulties

The headaches, the memory problems, the fact that work is harder than it was. This is where most brain injury claims are won or lost, and it is why documentation matters more here than in almost any other kind of injury case.

What a brain injury claim can account for

Every claim is different and no one can tell you what yours is worth from a web page. What an attorney can do is tell you which of these apply to your situation. Try the brain injury settlement estimator.

Colorado filing deadlines

Miss the deadline and the claim is gone, however strong it was. These are the general limits — several exceptions can shorten or extend them, which is worth a conversation rather than a guess.
